FOR LEAVE TO SUPPLEMENT THE RECORD
Robert B. Sklaroff, MD, Petitioner below and Appellant above, moves
this Honorable Court for leave to supplement the record with a copy of
a brief filed on July 5, 2000 with the United States Supreme Court, and
avers in support thereof:
1. The matter before the U.S. Supreme Court is directly related to the case that is pending before the Superior Court of Pennsylvania; both are derivative of the Master Settlement Agreement [“MSA”] between the tobacco industry and inter alia Philip Morris Incorporated.
2. The issue of “enforcement” has permeated both cases, and it is extensively discussed in the Briefs that have been filed with both courts.
3. Therefore, review of this issue (and correlation with argument provided to another Court dealing with the MSA) will assist the Court in this case.
4. Therefore, Dr. Sklaroff respectfully requests the record be supplemented
by the appended Briefs.
